Distance Sales Agreement – Made by my hand

This Distance Sales Agreement (“Agreement”) is entered into between the Buyer (Customer) and the Seller (madebymyhand.com), in accordance with the relevant provisions of the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. By completing a purchase through https://madebymyhand.com, the Buyer agrees to the terms outlined below.

2. Subject of the Agreement

This Agreement governs the rights and obligations of the parties concerning the sale and delivery of the goods ordered by the Buyer electronically from the Seller’s website https://madebymyhand.com.

3. Product Characteristics

All products offered by madebymyhand.com are handcrafted and made-to-order. Each item is produced individually and may vary slightly from product images due to its artisanal nature.

4. Prices and Payment

All product prices are listed in [Currency] and include applicable VAT and taxes.
Shipping costs are displayed during checkout and added to the total.
Payment methods include [Credit Card, PayPal, Bank Transfer, etc.].
The order becomes binding upon confirmation of successful payment.

5. Delivery Terms

Products are generally shipped within 30 business days from the date of order confirmation, unless otherwise stated.

6. Right of Withdrawal (Cancellation Policy)

In accordance with applicable consumer protection laws:

6.1 Standard Right of Withdrawal

The Buyer may cancel the order within 14 calendar days after receiving the product.
However, this right does not apply to personalized or custom-made products (see 6.2).

6.2 Exclusion – Custom-Made Products

Products made upon the Buyer’s personal specifications (e.g., custom colors, names, engravings, dimensions) are non-refundable and non-cancellable once production has started.
By placing an order for such custom-made products, the Buyer explicitly waives the right of withdrawal.

6.3 Returns for Defective Items

In the case of defective or misdescribed products, the Buyer may request:
- Repair or replacement
- A partial refund
- A full refund if repair/replacement is not possible
The defect must be reported within 7 calendar days of delivery.

7. Return Procedure

If eligible for return (non-custom, faulty item), the Buyer must return the product within 14 days of notifying the Seller.
Products must be unused and returned in their original packaging.
Return shipping is at the Buyer’s expense unless the item is faulty.

8. Refunds

Refunds for eligible returns are processed within 14 business days from receipt of the returned product.
Refunds are made via the original payment method.
The Seller may withhold refund until receiving the product or proof of return.

9. Limitation of Liability

The Seller is not responsible for minor visual differences due to the handmade nature of the products.
The Seller is not liable for delays caused by force majeure or third-party carriers.
Ownership and risk of loss transfer to the Buyer upon delivery.

10. Personal Data Protection

Personal information collected through the website is used only for order processing and communication, in accordance with our [Privacy Policy].

11. Complaints and Dispute Resolution

Disputes within the jurisdiction of Turkish consumer arbitration committees will be resolved accordingly.

13. Final Provisions

By placing an order, the Buyer acknowledges and accepts all the terms of this Distance Sales Agreement.
This Agreement is valid as of the date the Buyer completes the purchase through https://madebymyhand.com.
